Terms of Service
These terms govern your use of the RE/cation app and website. By creating an account you agree to them. Please read them, especially the sections on payment, handover and liability.
1. Who we are
Racation AS (organisation number 937980272)
Eidvegen 638, 9105 Kvaløya, Norway
Email: anders@recation.app
Racation AS operates RE/cation, a marketplace where travellers sell gear they no longer need to other travellers, with a local Keeper storing the item and handling the handover in between.
2. Our role
RE/cation is a platform. The sale itself is a contract between the Seller and the Buyer. We are not the seller of any item, and we do not own or inspect the items. What we do is provide the marketplace, connect the parties with a Keeper, collect the Buyer's payment, hold it until the handover is confirmed, and pay out the Seller and the Keeper.
3. Accounts
- You must be at least 18 years old.
- You must give accurate information and keep it updated. Use your real name.
- One account per person. You are responsible for everything done through your account and must keep your password safe.
- You may delete your account at any time in Settings. Open transactions must be completed or cancelled first.
4. Roles
Seller: lists an item, drops it off with a Keeper, and receives payment when the Buyer has collected it.
Buyer: makes an offer, pays through the app, and collects the item from the Keeper.
Keeper: a local person or business that stores items, checks them at drop-off, and hands them to the Buyer. Keepers are independent contractors, not employees or agents of Racation AS.
5. Listings
- You may only list items you own and have the right to sell.
- Photos and descriptions must be accurate. Known defects must be disclosed.
- Prohibited: weapons, drugs, stolen goods, counterfeit products, items that are illegal to sell or possess in Norway, and anything hazardous to store.
- Listings go live when the Keeper has received and checked the item.
- A listing is active for 30 days from when it goes live. After that it expires and the Seller must collect the item or agree a new arrangement with the Keeper.
Automatic price reduction
To help items sell before you leave, prices are reduced automatically while a listing is active: 20 % after 14 days, 40 % after 28 days and 60 % after 42 days, measured from the original price. You are notified before each reduction. You can change the price yourself at any time, which restarts the clock.
6. Offers and acceptance
- A Buyer may offer the asking price or a different amount. An offer is valid for 24 hours.
- When the Seller accepts an offer, a binding sales agreement is formed between Seller and Buyer, and other pending offers on that item are declined.
- The Buyer must pay within a reasonable time after acceptance. Until payment is made, the Seller may cancel.
7. Payment, fees and payouts
- All prices are in Norwegian kroner (NOK). Payment is made by card through Stripe.
- Racation AS holds the payment until the Buyer confirms in the app that they have received the item. This protects both parties.
- When the Buyer confirms, the sale price is split: 80 % to the Seller, 10 % to the Keeper and 10 % to Racation AS as a service fee. The Seller and Keeper see their share before accepting.
- Sellers and Keepers are paid through Stripe Connect and must complete Stripe's identity verification before they can receive payouts. Payout timing follows Stripe's schedule.
- Buyers pay no fee beyond the sale price.
- Each user is responsible for their own tax on income from RE/cation. Racation AS may report income to the Norwegian Tax Administration where required by law.
8. Drop-off, storage and handover
Drop-off
The Seller brings the item to the Keeper at an agreed time. The Keeper checks that the item matches the listing, notes its condition and takes photos. The Keeper may refuse an item that does not match the listing or is unsuitable to store.
Storage
The Keeper stores the item with reasonable care for up to 30 days. If an item is not sold, the Seller must collect it or arrange with the Keeper what should happen to it. Items not collected within 30 days after the listing expires, and where the Seller cannot be reached, may be donated or disposed of.
Pickup
The Buyer collects the item from the Keeper and should inspect it before confirming. All items are sold second-hand and as-is. By confirming receipt in the app, the Buyer accepts the item in its current condition and payment is released. The Buyer must collect and confirm within 14 days of payment. If they do not, Racation AS may cancel the transaction and refund the Buyer, or, after contacting both parties, complete it.
9. Problems, cancellations and refunds
- If the item at pickup is clearly different from the listing and the Keeper's drop-off photos, the Buyer may decline it and report the problem in the app within 24 hours. The payment stays on hold while we review.
- We compare the listing, the Keeper's photos and the Buyer's report and decide within 5 working days whether the Buyer is refunded or the sale is completed. Our decision is based on the documentation available and is final within the platform. It does not limit your legal rights.
- Once the Buyer has confirmed receipt, the sale is complete and refunds are not available through RE/cation.
- If a Seller fails to drop off an item, or a Keeper cannot hand it over, the Buyer is refunded in full.
10. Keeper terms
In addition to the rest of these terms, Keepers agree to:
- Check every item against its listing at drop-off and photograph it.
- Store items safely and separately from their own belongings, and not use them.
- Be reachable and available for handovers within the opening hours they have set.
- Hand items over only to the Buyer shown in the app, after the Buyer has paid.
- Be responsible for loss of or damage to an item while it is in their custody, up to the item's sale price, unless caused by the Seller's own misdescription.
- Not contact users to trade outside the platform.
Racation AS may suspend or remove a Keeper at any time for breach of these terms, poor ratings or inactivity.
11. Conduct
You must not: circumvent the platform to trade directly and avoid fees; harass other users; post misleading content; use the service for money laundering or fraud; or attempt to access data or accounts that are not yours. We may remove content and suspend or terminate accounts that break these rules.
12. Content and ratings
You keep ownership of the photos and text you post. You grant Racation AS a licence to display them in the app and in marketing for the service while the listing exists. Ratings must be honest and relate to the actual transaction. We may remove ratings that are abusive or unrelated.
13. Liability
- Racation AS is not a party to the sale and is not liable for the condition, safety, legality or fitness of any item, or for the actions of Sellers, Buyers or Keepers.
- We provide the service as it is. We do our best to keep it available but do not guarantee uninterrupted operation.
- To the extent permitted by law, our total liability to you for any claim related to the service is limited to the fees we have received from your transactions in the 12 months before the claim.
- Nothing in these terms limits liability for gross negligence or intent, or rights you have as a consumer under mandatory Norwegian law.
14. Termination
You may stop using the service and delete your account at any time. We may suspend or terminate your account if you breach these terms, if required by law, or if we discontinue the service. Any payments held for completed handovers will still be paid out.
15. Changes
We may update these terms. If a change is significant we will notify you in the app or by email at least 14 days before it takes effect. Continued use after that date means you accept the new terms.
16. Governing law and disputes
These terms are governed by Norwegian law. Disputes between you and Racation AS are settled by Norwegian courts, with Nord-Troms og Senja District Court as the agreed venue, unless mandatory consumer law gives you the right to bring the case elsewhere. Consumers in Norway may also contact the Norwegian Consumer Council (Forbrukerrådet) for mediation.
